ABSTRACT

The 2012 European Court of Human Rights Hirsi judgment is an authoritative jurisprudential precedent indirectly attesting to serious human rights violations in Libya vis-à-vis migrants. Since then, the risk of abuse of migrants in Libya has become increasingly worse, due, inter alia, to the deterioration of the political situation after the fall of Gaddafi in 2011. Conditions in the centres were inhuman, with people held in warehouses in appalling sanitary conditions, with poor ventilation and extremely limited access to light and water. In some detention centres, migrants suffered from severe malnutrition, and United Nations Support Mission in Libya (UNSMIL) received numerous and consistent reports of torture, including beatings and sexual violence, as well as forced labour by armed groups with access to the centres. The report adds that "UNSMIL has been reviewing its support to the Libyan Coast Guard in line with the United Nations human rights due diligence policy".
