ABSTRACT

Article 243ZF of the 74th Constitution Amendment Act (CAA) required the state governments to bring changes in the laws relating to municipalities that existed immediately before the commencement of the 74th CAA. The state governments followed the constitutional provisions and incorporated the constitutional provisions in their existing municipal laws, the changes brought about in the conformity laws vary a great deal across the states. Though Article 243Q of the Indian Constitution provides for mandatory constitution of three types of urban local self-governments, it gives discretion to the states about the nomenclature of especially the Nagar Panchayat. The range of population for constituting three types of urban local self-governments thus varies a great deal in different states. The states have discretion to create either a multiple Wards Committee or a Ward Committee in each ward especially in the cities and towns with more than 3 lakh population.
