ABSTRACT

The influence of law on sport governance reveals an attempt by courts and legislators to balance the organisation’s desire for autonomy – to conduct its affairs in the best interests of the sport – against the need for the law to regulate the behaviour of entities within its jurisdiction. The European Union itself is established under treaties adopted by the 28 member states. The World Anti-Doping Agency is a Swiss private law foundation with its formal legal base in Lausanne Switzerland, however its operational headquarters are in Montreal, Canada. The Convention also helps to ensure the effectiveness of the World Anti-Doping Code. As the Code itself is a non-government document that applies only to members of sports organisations, the Convention provides the legal framework under which governments can address specific areas of the doping problem that are outside the domain of the sports movement.
