ABSTRACT

This chapter argues that there is an implicit relation that exists between the disciplines of law and psychology. The most effective way to illustrate this relation is to look at law and psychology in action, and the chapter focuses on the topic of rape law. The effects of the implicit relation will now be illustrated through consideration of rape law. In particular, attention will be given to one relatively recent development in rape law - evidence of rape trauma syndrome, because it represents a singularly clear expression of the law and psychology relation. Rape law exemplifies normative expectations of women’s behaviour. An entire mythology has taken root and continues to influence attitudes of the police, lawyers, judges and juries. Moreover, the hidden nature of the implicit relation between the two disciplines operates pervasively and invidiously. The result, whether deliberate or not, is a powerful collusion between law and psychology which works actively against the interests of women.
