ABSTRACT

This chapter examines de-classified memoranda and reports, as well as insiders’ accounts, to provide an in-depth analysis of the US detention and interrogation policies during the War on Terror. The analysis demonstrates the impact of legal advisers on policy shifts. Corroborating the compliance effect of lawyerization, the case study shows to what extent, and through which mechanisms, the lawyerization of the state makes legal advisers the main agents of compliance within the state.
