ABSTRACT

Finally, Chapter 8 reaps the benefits of previously evaluating the legal question of private military company (PMC) regulation through a critical lens of historical sociology. Based on the claim of a 'shared governance' model established in Chapter 6, and the availability of private law sources, PMCs and corporations more generally have developed an extent of authority that requires a proportionate degree and extent of responsibility. This chapter explores why we need corporate criminal liability for PMCs internationally and offers potential future legal responses for its implementation. It considers different avenues within international criminal law for a more effective and tailored regulation of the private military space, mindful of the doctrinal limitations and taking into consideration the evolving shared governance model.
