ABSTRACT

More people are gambling online than ever before. How they do it and what they play is their business, unless of course you plan to make it your business. Whether you’re creating a new game that includes gambling, adding wagering to an existing game, or operating an app that you are worried might qualify as an illegal game of chance, an understanding of how gambling is treated under the law can mean the difference between laughing all the way to the bank and standing up when the judge calls your name. This chapter will discuss how state laws determine when an activity qualifies as illegal gambling, the relevant federal laws that may be applicable to online gambling, the jurisdictions in which some forms of online gambling are permitted, and what the future might hold for online gambling in the United States.
