ABSTRACT

Aerospace manufacturing activity as such is not a distinct subject of EU law. However, this activity is governed by numerous parts of EU law including aviation-specific regulations, which facilitate trans-border aerospace production in the EU. The EU aerospace sector is dependent on intra-community supply of components. The primary area of aviation law relevant for the aerospace industry where Brexit will leave an imprint is aviation safety regulations, namely technical requirements for aviation products. The British industry is also dependent on recruiting skilled aerospace workers on the continent, and this ability will not be protected by the Treaty after Brexit. Levying customs duties for aerospace products would also be required, although at least as regards civil aircraft, their engines, subassemblies, parts and components, this effect can be partly achieved by means of the existing World Trade Organization agreement on trade in aircraft.
