The impact of Brexit on the distribution of legislative powers will be quite straightforward. Within the scope of European Union (EU) competences, these powers are normally realised by the European Parliament and the Council. As regards pending legislative business, Brexit will bring mixed results. The United Kingdom (UK) will obviously not be bound by any EU laws that will enter into force on Exit Day or after. EU acts which enter into force before that day will apply in the UK until Brexit. The UK’s exit from the EU will not directly impact upon EU legislative procedures. The relevant provisions of the Treaties will be left intact by Brexit, but without Britain the arithmetic of voting in the EU will change. Within the EU, Britain has regularly been a strong supporter of liberalisation initiatives concerning aviation. Therefore, some worries have been expressed that without the UK’s voice, EU aviation policies and regulations may become more restrictive.
