ABSTRACT

The UK exit from the EU will bring about important changes for the judicial branch of the UK and the EU27; however, none of the changes are aviation-specific. The main result would be that the Court of Justice will lose its jurisdiction over the UK in respect to all issues dealt with by this court in accordance with the Treaty on the Functioning of the European Union. Brexit may also have an effect on pending UK court proceedings pertaining to matters governed by EU law. However, the exact impact on these proceedings will likely depend on their nature and subject. These issues will be subject to transitional and grandfather provisions introduced by British lawmakers. Withdrawal from the EU means that British courts would no longer be obliged to construe national laws in line with the spirit of the relevant EU rules.
