ABSTRACT

Claims for damages for occupationally-induced illness/disease have been brought before the courts since the end of the 19th century. Legal actions for asbestos-related disease, occupationally-induced deafness, vibration white finger, repetitive strain injury, and, most recently, stress at work, to name but a few, are commonplace in the field of personal injury law. A brief review of volumes 3 and 4 of Kemp and Kemp’s The Quantum of Damages (Sweet and Maxwell) reveals how frequently such claims are litigated.
