ABSTRACT

This chapter provides a comparative analysis of water allocation law and policy between Australia and New Zealand. It is at the level of New Zealand and the Australian states of Victoria, New South Wales, South Australia and Western Australia. It examines detailed water allocation law and policy with regards to water laws, water register information, water allocation method, water transfers in markets, the extent of unbundling of water rights and so on. It highlights the gaps between water allocation law and the policy between Australia and New Zealand. It also provides insight on how different Australian states have interpreted and applied Commonwealth legislation within their own states.
