ABSTRACT

Providing both actual case law and hypothetical situations for consideration, this chapter explores legal decisions on procurement, contract formation, the acceptance and rejection of goods, and cases involving the rights of both parties in contract awards. In addition to cases regarding contract administration, hypothetical studies parallel issues related to Article 2 of the Uniform Commercial Code with respect to liquidated damages, the effects of indefiniteness in contracts, the unenforceable terms of a purchase order, applying implied warranties to a contract breach, the implications of law of agency, and volume purchase commitments, providing readers with a practical, actionable walkthrough of case discussion for better application of conceptual knowledge.
