ABSTRACT

This chapter considers artistic elements. Since artistic elements are not parts of artworks, they are not protected by copyrights on works. In particular, fictional characters ought not to be protected by copyright. The chapter grants that they ought to receive some sort of short-term protection, akin to patents. The use of other artistic elements, such as styles and plots, ought to be completely unrestricted. A section of the chapter is devoted to the thinking of indigenous peoples about ownership of styles.
