ABSTRACT

In this chapter, we shall attempt a discussion of the safeguards of judicial independence from a non-traditional perspective. This means that the primary focus of the chapter will not be a discussion of the constitutional provisions which ensure that judges of the superior courts enjoy security of tenure. Rather, it will be on related issues, an assessment of the decisions of the Caribbean Court of Justice since its establishment on 16 April 2005, problems with the administration of justice, judicial training, judicial independence and accountability, and alternative dispute resolution techniques. Concerns over the impeachment and threatened impeachment 1 of a couple of judges in the region have led to a heightened interest in the topic of judicial independence and judicial accountability. A great deal has occurred since the second edition of this book which must now be highlighted.
