ABSTRACT

An important issue to keep in mind when navigating through motor carrier legal compliance is to understand the relationship between federal laws and state laws. The Department of Transportation has four regulations that address various aspects of this issue. The first regulation is 49 Code of Federal Regulations (CFR) 350: Commercial Motor Carrier Assistance Programs. The second regulation is 49 CFR 355: Compatibility of State Laws and Regulations Affecting interstate Motor Carrier Operations. The third regulation is 49 CFR 384: State Compliance with Commercial Driver’s License Program. The fourth regulation is 49 CFR 388: Cooperative Agreements with States. States may apply for various types of grants depending on their level of program implementation. The types of grants available include basic grants, Supplemental grants and Special grants. States may make cooperative agreements with the federal government for applying both federal and state laws within their state. The regulatory guidance for this is found in 49 CFR 388.
