ABSTRACT

This chapter discusses how hazardous materials must be transported. It addresses two regulations: 49 Code of Federal Regulations (CFR) 177—Carriage by Public Highway and 49 CFR 397—Transportation of Hazardous Materials: Driving and Parking Rules. When an internal transportation department is utilized for a company’s product distribution, the shipper, motor carrier, and receiving party may all be of the same employer. The Department of Transportation exercises the freedom to conduct various inspections to ensure that motor carriers are in compliance with the appropriate Department of Transportation (DOT) regulations. Appropriate shipping papers must accompany any shipment of hazardous materials. These papers are necessary for identification of the types of materials being carried, as well as for providing emergency response information in the event that an incident occurs. 177.817 states the requirement for shipping papers to have a shipper’s certification.
