ABSTRACT
The bind over is a historic power traditionally requiring someone to ‘keep the peace’. An agreed sum of money is payable if conditions are broken. It is not a sentence and the Law Commission, in 1994, said that it was an anomaly and should be abolished. However, more recently it has found favour with the government as an instrument to control anti-social behaviour, provided specific conditions are made.
