ABSTRACT

The expansion of EU discrimination law over a wider range of grounds opens up the possibility of addressing multiple and intersectional sources of discrimination. But the extent to which intersectionality can be addressed is hampered by established models of anti-discrimination enforcement, which depend on individual complaints to courts or tribunals. At the same time, it is increasingly recognised that the complaints-led approach to equality needs to be supplemented by proactive duties if real change is to be achieved. This chapter examines the extent to which proactive duties to promote equality can be harnessed to address the challenges of intersectionality.
