ABSTRACT

Yet only recently has Indonesia again been named one of the world’s most corrupt states (Transparency International 2004),4 and human rights organizations regularly complain about continued impunity for perpetrators of grave human rights violations. Most people would agree that such a state of affairs regarding the judiciary clearly contradicts the rule of law principle. However, a more difficult task than listing the conditions in Indonesia that are contrary to the rule of law concept is to define what constitutes the same.
