ABSTRACT

In Part 26 of the CA 2006, the term ‘arrangement’ includes a reorganisation of the company’s share capital by the consolidation of shares of different classes, or by the division of shares into shares of different classes, or by both of those methods;7050 and the term ‘company’ (a) in s 900 of the CA 2006 (powers of court to facilitate reconstruction or amalgamation) means a company within the meaning of the CA 2006,7051 and (b) elsewhere in Part 26 of the CA 2006 means any company liable to be wound up under the Insolvency Act 1986 (c 45) or the Insolvency (Northern Ireland) Order 1989 (SI 1989/2405 (NI 19)).7052
