ABSTRACT

On the basis of the current arguments, sporting authorities would find it difficult to justify banning genetically modified athletes from sport. Moreover, it is not even clear whether sporting authorities should have the power to make such decisions, given the broader context within which genetic modification would take place (i.e. non-sporting alterations). Equally, the ability of sporting authorities to request genetic information from athletes so that they might test for enhancement is difficult to justify, particularly where it may require a significantly invasive procedure (as might be said for a muscle biopsy to determine the modification of muscle tissue).
