ABSTRACT

States, through their participation in the international climate change regime, have accepted legal obligations on climate finance. Some elements of the law are apparent from the treaties themselves, while others require careful exposition. Such an exposition is the aim of this chapter. The chapter offers a restatement of climate law – the first of its kind – including climate finance law. (The challenge of applying the law to the ‘facts’ of climate finance is taken up in Chapter 4.) The exercise will reveal that climate finance law is an integral part of climate law, so that we cannot make sense of one without an understanding of the other. Throughout, I stay close to ‘the law as it is’. I do not attempt to offer a conception of the law as it ought to be.
