ABSTRACT
This chapter is the first of several that look at various arguments which may be used by the parties to a contract to say that the agreement should be regarded as ‘void’ or ‘voidable’. These arguments are often grouped under the general heading of ‘vitiating factors’. The two that are considered in this chapter are ‘mistake’ and ‘misrepresentation’.
