Initiator of Community action The Commission has historically had the right of legislative initiative, and Council decisions are taken on the basis of Commission proposals. Under Art 192 (formerly Art 138b) of the EC Treaty, the European Parliament can ‘request’ a proposal when it considers legislation to be necessary. The Commission does not accept that it must bring forward legislative proposals when faced with such a request.
