ABSTRACT

Under any constitution there must be an ultimate authority, or power. In a country with a written constitution, the constitution will have its origins in the historical formation of the state and the drafting of a set of rules to govern the state. The original authority of the constitution comes from the people within the state, who are said to be politically sovereign. Once drafted the constitution becomes the supreme legal power within the state and any laws that contradict the constitution will be declared to be null and void by the Supreme Court. In other words the constitution is legally sovereign.
