ABSTRACT
In Mabo,1 the High Court adopted with approval the fundamental constitutional proposition stated by Gibbs J in Seas and Submerged Lands 2 that the courts cannot challenge or interfere with acts of State such as the ‘acquisition of Territory by a sovereign state’.
