ABSTRACT
The tendency and coincidence rules (defined in the Dictionary to mean ss 97(1) and 98(1)) are rules of conditional exclusion, that is, the evidence is excluded if two conditions are not met, being reasonable notice in writing of the intention to lead the evidence, and significant probative value of the evidence. Sections 97 and 98 apply in both civil and criminal proceedings.
