ABSTRACT

The concept of relevance is foundational to the whole of the law of evidence. In this chapter, several different aspects of the concept of relevance are explored, including:

• its role as the fundamental test for the admissibility of evidence;

• the different ways in which evidence can be relevant;

• the way in which the requirement of relevance should be applied;

• the concept of ‘provisional’ relevance; and

• the discretionary exclusion of evidence where its probative value is outweighed by other dangers.
