ABSTRACT

Every valid express trust must, in addition to satisfying the certainty rules discussed in Chapter 27, and not being void for public policy reasons (see Chapter 31), meet two other requirements: • the trust must be properly declared; and • the trust property must be properly vested in the trustee or trustees.
