ABSTRACT

In a general sense, ‘equity’ means ‘fairness’. In Australian law, equity is that body of rules originally enforced by the Court of Chancery. Equity has been described as ‘a gloss on the common law’ (meaning a supplement to the common law), filling in the gaps and making the legal system more complete.
