ABSTRACT
Generally, a lawyer’s liability to a client lies in the common law (contract and tort), equity and statute. A lack of competence on the part of the lawyer may give rise to a claim in contract, and/or in negligence, and may result in disciplinary proceedings for unsatisfactory professional conduct (or even professional misconduct in serious cases).
