Introduction Both during the marriage and on marriage breakdown, the home serves two linked but distinct functions: first it is a roof for the couple or family, and may remain so for one of the spouses and any family after separation and divorce, and secondly it is usually the couple’s most valuable capital asset (although the value of pension rights may well come a close second to that).
