ABSTRACT

Orders which the court may make Ancillary relief (ie a financial order dealing with the spouses’ money and property) is available following decrees of divorce, nullity, judicial separation and presumption of death and dissolution of the marriage. The court’s power, which is contained in ss 23 and 24 of the MCA 1973, arises in the case of orders for spouses ‘on granting a decree ...’ and is subject to the court’s consideration of the matters contained in s 25 of the Act, which details the matters which the court must take into account when exercising its powers under ss 23 and 24.
