ABSTRACT
There are certain types of offences to which the Commission suggests consent should never be a defence. These are those which involve the D in inflicting ‘serious disabling injury’ either intentionally, or recklessly.80 Implicit in this is that the a person who intentionally or recklessly causes fatal injuries cannot plead consent.
