ABSTRACT

Public Privilege Public privilege is not an area which will be encountered frequently in the rent review process.

Private Privilege Private privilege is basically divided into two areas. The first area is correspondence between solicitor and client. Such correspondence is always privileged, but the privilege and protection may be waived if the person relying on that privilege no longer seeks to rely on it. Thus, it is quite in order for the party who wrote to the solicitor to put that correspondence into the hearing should it be so desired. It is the other side who cannot force the parties to the correspondence to make it public.
