ABSTRACT
The judge indicated that the meaning sought by the landlord did appear unfair. It did benefit the landlord should a delay occur between the time when the tenant sought a determination by the independent surveyor and the actual date of the determination. However, where there was a clear statement of the desires of the parties, that should not be ignored unless within 'the four comers' of the lease there were evidence to the contrary.
