A sensible conclusion but one which ignores the situation where inducements are given to occupy premises in a falling market or where very favourable terms are given in order to secure an anchor tenant. Whenever this arises the tenant is well advised to add a rider to the assumption provision setting out the exact situation applicable to the inducement.
