CHAPTER IV : DESIGNATION OF INSULAR FEATURES IN TREATY INSTRUMENTS; “ISLAND”, “ISLET” AND “ROCKS”; NOTION OF “ADJACENCY” AND “DEPENDENCY”

133. The dispute over title to certain insular features, in essence, is a question of treaty interpretation. It involves conflicting interpretation of treaty provisions governing attribution of sovereignty.In view of this, the terms of the relevant treaty instruments assume particular significance. It would therefore be appropriate to dwell briefly on the terms of Lausanne and Paris Peace Treaties designating the insular features as well as the notions of “dependency” and “adjacency” used for the purpose of attribution of sovereignty.
