ABSTRACT

A business concern may elect to have its goods and services reach the final consumer through several business arrangements. One such mechanism is that of agency. Agency is the relationship arising where one person, the principal (P), appoints another, the agent (A), to bring about, modify or terminate legal relations between the principal and one or more third parties (T). Thus, it has been argued that there are three essential qualities of agency. These are the consent of both the principal and agent, the authority of the agent to affect the principal’s legal position, and the principal’s control of the agent’s action.
