ABSTRACT

This chapter focuses on the county court; in any event, there is little difference procedurally under the Civil Procedure Rules. It is extremely unusual for straightforward litigation concerning residential leaseholds to take place in the High Court, whether it is in terms of debt recovery, contractual disputes or possession actions. The claim form and its attachments and a cheque for the court fee are delivered to the court office. The court clerks then issue the proceedings and serve the papers on the defendants by post, together with a "Response Pack" which consists of an admission form, a defence and counterclaim form and a form for acknowledging service of the claim. The court clerk places the completed allocation questionnaire on the court file and arranges a hearing before the district judge, sending notification of the date and time and details of application to the parties. The court's directions are its various orders and requirements to be carried out before the hearing.
