ABSTRACT

This chapter concerns circumstances which can arise in connection with an existing electric line. The hypothetical legal and factual context in which consider the issues raised by the chapter is this: a wayleave has come to an end by one or other of the ways; a valid notice to remove was duly served by the grantor upon the licence-holder. The chapter suggests that the licence-holder does not become obliged to remove the electric line until the three months period from service of the notice to remove has expired. The licence-holder must remove the electric line at the end of the period of one month beginning with the date of the Secretary of State's decision or such longer period as the Secretary of State shall direct. The chapter discusses the context in which the consequences is that the licence-holder is under a statutory obligation to remove the electric line.
