ABSTRACT

This chapter concerns public inquiries held in relation to applications for consent for overhead electric lines under section 37 of the Act by licence-holders in circumstances where objections have been made by the local planning authority. It addresses public inquiries convened under section 62 of the Act where objections have been made by persons other than the local planning authority and the procedure for reviews of existing consents. Qualifying objector means the local planning authority and any person who has made a written objection to the application to the Secretary of State prior to the Secretary of State's written notice of his intention to cause a public inquiry to be held. It would be normal practice for the inspector to examine witnesses after the licence-holder and objectors have finished their questioning. Following cross examination the opportunity exists for the licence-holder's advocate to re-examine the witness in order to deal with points of clarification for the benefit of the inspector.
