ABSTRACT

This chapter concerns the definition of the four most significant remedies for our own purposes: debt, damages, mesne and injunctions. A debt is a sum of money due and owing in return for the performance of a corresponding obligation. It is an essential precondition of a debt that it is a fixed amount which is known before legal action begins or is capable of being calculated. Damages is the term given to the financial compensation which a court orders one person to pay to another. Mesne profits are intended to compensate a landowner or occupier for wrongful use of his land. The technical term for a court order to do or not to do something is an injunction. The chapter discusses a commentary on the Civil Procedure Rules. Injunctions are granted if the court thinks fit on the evidence presented to it.
