ABSTRACT

Beyond negotiation, mediation is the other big and popular process used under the umbrella of ADR. Mediation is an old form of dispute resolution process. It has been practised for centuries in Africa, China, the Far East and now, recently, in the western world. H Alves had this to say about the origins of mediation:

This quotation reinforces the point made in Chapter 1 to similar effect. According to CW Moore,2 ‘mediation has a long and varied history in almost all

cultures of the world. Jewish, Christian, Islamic, Hindu, Buddhist, Confucian and many indigenous cultures all have extensive and effective traditions of mediation practice’.
