ABSTRACT

A landlord who has received a request for a new tenancy and who does not wish to grant the tenant a new tenancy must, within two months of receipt of the request, give notice to the tenant, stating that the grant of a new tenancy is opposed and specifying the s 30 ground(s) on which it is intended to rely (s 26(6) of the 1954 Act). There is no prescribed form of notice; however, it should be in writing and be served on the tenant (see Appendix 20 for an example of a form of notice). In M & P Enterprises (London) Ltd v Norfolk Square Hotels Ltd [1994] 1 EGLR 129, the landlords served defective s 25 notices on the tenant after having received a s 26 request. The s 25 notices stated that the landlords would oppose the grant of a new tenancy. It was held that the landlords had complied with the requirement to give the tenant notice that they would oppose its application for a new tenancy.
