The court can, if it thinks fit, include a rent review clause in the new tenancy (s 34(4) of the 1954 Act). The questions which arise if the court decides to include a rent review in the new tenancy are, first, what the period of review should be and, secondly, whether the review should be upwards only or both upwards and downwards and, finally, what the terms of the rent review clause should be.
