ABSTRACT

Where the contractual term has ended and the tenancy is continuing under s 24 of the 1954 Act the tenant can, under s 27(2) of the 1954 Act, give the immediate landlord (who may not be the competent landlord) not less than three months’ notice in writing to bring the tenancy to an end on any day. A s 27(2) notice cannot be given until the tenant has been in occupation for at least one month. There is no prescribed form of notice. A s 27(2) notice will not affect any sub-tenancy which is protected by the 1954 Act. Once a tenant has served a s 27(2) notice, it is not allowed to serve a s 26 request (s 26(4) of the 1954 Act).
