ABSTRACT

Once the third party has made an award, the tenant can still exercise its right under s 36(2) of the 1954 Act to elect not to take up a new tenancy (see 9.7). In order to make such an election, it will first have to apply to the court for an order for the grant of a new tenancy on the terms agreed between the parties and those determined by the third party and then, within 14 days of the order being made, apply under s 36(2) for it to be revoked.
