The landlord should serve a schedule of dilapidations on the tenant, together with a request that the repairs be carried out. In practice, this will be prepared by the landlord’s surveyor. Evidence that the landlord has brought forfeiture proceedings will also be of value. The landlord’s surveyor will be able to give evidence as to the estimated cost of the repairs and the likely time for carrying them out, together with whether they have caused any loss in value to the landlord’s reversion.
